Gerichtliches Inkasso<\/h2>\n<p class=\"\" style=\"white-space:pre-wrap;\">Ziel des gerichtlichen Inkassos bzw. der gerichtlichen Forderungsbetreibung ist es, in einem Zivilverfahren ein rechtskr\u00e4ftig und vollstreckbares Urteil gegen den Schuldner zu erlangen.<\/p>\n<h3 style=\"white-space:pre-wrap;\">2.1 \u00d6sterreichisches Mahnverfahren<\/h3>\n<p class=\"\" style=\"white-space:pre-wrap;\">Das \u00f6sterreichische Recht bietet Gl\u00e4ubigern f\u00fcr die Durchsetzung ihrer Geldforderungen ein besonderes Verfahren an, das sogenannte Mahnverfahren.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Dieses Verfahren ist zur Durchsetzung von Geldforderungen bis EUR 75.000,00 zwingend.<br \/>Es handelt sich um ein rasches, effizientes und kosteng\u00fcnstiges Verfahren f\u00fcr das Inkasso von Geldforderungen. Das Mahnverfahren beginnt mit einer Mahnklage, die elektronisch beim zust\u00e4ndigen Gericht eingebracht wird.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">F\u00fcr Geldforderungen bis EUR 15.000,00 sind die Bezirksgerichte und f\u00fcr Geldforderungen \u00fcber EUR 15.000,00 sind die Landesgerichte zust\u00e4ndig.<br \/>Sonderzust\u00e4ndigkeiten bestehen, wenn der Schuldner ein im Firmenbuch eingetragener Unternehmer (z.B. eine GmbH) ist:<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">In diesem Fall ist in Wien das Bezirksgericht f\u00fcr Handelssachen bzw. das Handelsgericht Wien zust\u00e4ndig.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Aufgrund der Mahnklage erl\u00e4sst das Gericht einen Zahlungsbefehl.<br \/>Dieser Zahlungsbefehl wird dem Beklagten zugestellt.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Der Beklagte hat zwei M\u00f6glichkeiten:<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Entweder bezahlt er die Forderung samt Kosten binnen 14 Tagen nach Zustellung des Zahlungsbefehls <span style=\"text-decoration:underline\">oder<\/span> er erhebt binnen vier Wochen Einspruch gegen den Zahlungsbefehl.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Wenn der Beklagte keinen oder keinen rechtzeitigen Einspruch gegen den Zahlungsbefehl erhebt, wird der Zahlungsbefehl rechtskr\u00e4ftig und vollstreckbar. Der Kl\u00e4ger erh\u00e4lt dadurch einen Titel, den er gegen den Beklagten im Exekutionsverfahren f\u00fcr die n\u00e4chsten drei\u00dfig Jahre vollstrecken kann.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Erhebt der Beklagte Einspruch gegen den Zahlungsbefehl, tritt der Zahlungsbefehl au\u00dfer Kraft und das ordentliche Verfahren wird eingeleitet:<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Dies bedeutet, dass das Gericht dem Kl\u00e4ger sowie dem Beklagten die Erstattung vorbereitender Schrifts\u00e4tze auftr\u00e4gt und eine Streitverhandlung (= vorbereitende Tagsatzung) anberaumt. Bei der vorbereitenden Tagsatzung werden zuerst Vergleichsgespr\u00e4che gef\u00fchrt.<br \/>Wenn kein Vergleich erzielt werden kann, wird das weitere <a href=\"https:\/\/www.silber.legal\/rechtsanwalt-prozessrecht\">Prozessprogramm <\/a>festgelegt (Einvernahme der Parteien, der Zeugen, Einholung eines Sachverst\u00e4ndigengutachtens etc.).<br \/>In der Folge werden die von den Parteien beantragten Beweise in ein oder mehreren Verhandlungen aufgenommen.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Nach Abschluss des Beweisverfahrens schlie\u00dft der Richter die Verhandlung. Das Urteil ergeht in der Regel schriftlich. Eine m\u00fcndliche Urteilsverk\u00fcndung findet selten statt. Der Prozessverlierer kann gegen das f\u00fcr ihn negative Urteil erster Instanz Berufung an die Gerichte zweiter Instanz erheben.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Als erfahrener Inkasso im Exekutionsverfahren<\/h2>\n<p class=\"\" style=\"white-space:pre-wrap;\">Das Exekutionsverfahren bietet dem Gl\u00e4ubiger die M\u00f6glichkeit, eine Geldforderung gegen den Schuldner mit staatlichem Zwang durchzusetzen. Voraussetzung f\u00fcr das Exekutionsverfahren ist ein Exekutionstitel. Ein Exekutionstitel kann beispielsweise ein rechtskr\u00e4ftiges Urteil, ein rechtskr\u00e4ftiger Zahlungsbefehl oder ein gerichtlicher Vergleich sein.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Das Exekutionsverfahren beginnt mit einem Exekutionsantrag des Gl\u00e4ubigers beim zust\u00e4ndigen Gericht. Dies ist in der Regel das Bezirksgericht. Im Exekutionsantrag ist unter anderem der Schuldner und das gew\u00fcnschte Exekutionsmittel anzugeben. Nach der Bewilligung des Exekutionsantrages wird die Exekution vom Gericht durchgef\u00fchrt.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Es gibt folgende Exekutionsarten zur Durchsetzung von Geldforderungen:<\/p>\n<ul data-rte-list=\"default\">\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">Liegenschaftsexekution<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">Fahrnisexekution<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">Forderungsexekution<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space:pre-wrap;\">Exekution auf Verm\u00f6gensrechte<\/p>\n<p class=\"\" data-rte-preserve-empty=\"true\" style=\"white-space:pre-wrap;\">\n<\/li>\n<\/ul>\n<p class=\"\" style=\"white-space:pre-wrap;\">Bei der Liegenschaftsexekution wird eine Liegenschaft des Schuldners zwangsversteigert, zwangsverwaltet oder durch ein Pfandrecht des Gl\u00e4ubigers belastet (= zwangsweise Pfandrechtsbegr\u00fcndung):<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Im Zuge der Zwangsversteigerung wird die Liegenschaft des Schuldners in einem gerichtlichen Verfahren versteigert und mit dem Erl\u00f6s die Forderung des Gl\u00e4ubigers befriedigt. Bei der Zwangsverwaltung einer Liegenschaft wird vom Gericht ein Verwalter bestellt, der die Liegenschaft des Schuldners mit dem Ziel verwaltet, \u00dcbersch\u00fcsse zu erzielen (z.B. Mieteinnahmen), mit denen die Forderung des Gl\u00e4ubigers befriedigt werden kann.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Durch die zwangsweise Pfandrechtsbegr\u00fcndung wird eine Liegenschaft, ein <a href=\"https:\/\/www.oesterreich.gv.at\/lexicon\/S\/Seite.991300.html#:~:text=Super%C3%A4difikate%20sind%20Geb%C3%A4ude%2C%20die%20auf,Dauer%20auf%20diesem%20Grundst%C3%BCck%20bleiben.\" target=\"_blank\">Super\u00e4difikat <\/a>(Bauwerk auf fremdem Grund) oder ein Baurecht des Schuldners durch ein Pfandrecht des Gl\u00e4ubigers belastet. Dieses Pfandrecht dient dazu, die Forderung des Gl\u00e4ubigers zu sichern.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Bei der Fahrnisexekution werden bewegliche Sachen des Schuldners verpf\u00e4ndet und anschlie\u00dfend gerichtlich verwertet. Der Gl\u00e4ubiger muss in seinem Exekutionsantrag einen Vollzugsort (z.B. die Wohnung des Schuldners oder den Ort seines Betriebes) angeben.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Die Fahrnisexekution wird vom Gerichtsvollzieher vollzogen, indem er den Vollzugsort aufsucht, die pf\u00e4ndbaren Gegenst\u00e4nde in ein Protokoll aufnimmt (= Pf\u00e4ndung) und diese Gegenst\u00e4nde entweder freih\u00e4ndig oder im Rahmen einer Versteigerung verkauft. Inkasso in der Insolvenz des Schuldners<\/h2>\n<p class=\"\" style=\"white-space:pre-wrap;\">Die Insolvenz des Schuldners ist f\u00fcr den Gl\u00e4ubiger der \u201eworst case\u201c:<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Der Schuldner ist zahlungsunf\u00e4hig bzw. \u00fcberschuldet. Aufgrund eines Antrages eines Gl\u00e4ubigers oder des Schuldners selbst er\u00f6ffnet das Gericht ein Insolvenzverfahren \u00fcber das Verm\u00f6gen des Schuldners. Das Insolvenzverfahren hat zur Folge, dass der Schuldner sein Verm\u00f6gen nicht mehr verwalten oder \u00fcber dieses verf\u00fcgen darf. Bereits anh\u00e4ngige <a href=\"https:\/\/www.silber.legal\/rechtsanwalt-prozessrecht\">Prozesse <\/a>und Exekutionen werden durch die Insolvenzer\u00f6ffnung unterbrochen.<br \/>Neue Prozesse oder Exekutionen k\u00f6nnen nach der Insolvenzer\u00f6ffnung nicht mehr gegen den Schuldner bzw. dessen Verm\u00f6gen gef\u00fchrt werden.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Die Er\u00f6ffnung des Insolvenzverfahrens wird in der Insolvenzdatei ver\u00f6ffentlicht. Die Insolvenzdatei kann online von jedem abgerufen werden. Gleichzeitig mit der Bekanntmachung der Er\u00f6ffnung des Insolvenzverfahrens setzt das Gericht eine Anmeldefrist f\u00fcr die Gl\u00e4ubiger des Schuldners fest:<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Dies bedeutet, dass Gl\u00e4ubiger ihre Forderungen gegen den Schuldner innerhalb dieser Frist beim zust\u00e4ndigen Gericht (Bezirks- oder Landesgericht) anmelden m\u00fcssen (= Anmeldungsfrist). Dar\u00fcber hinaus haben Privatbeteiligte u.a. das Recht auf Akteneinsicht, auf Teilnahme an der Hauptverhandlung und ein Rechtsmittelrecht.<\/p>\n<p class=\"\" style=\"white-space:pre-wrap;\">Weiters k\u00f6nnen Privatbeteiligte die Aufnahme von Beweisen beantragen und gegen die Einstellung des <a href=\"https:\/\/www.silber.legal\/anwalt-strafrecht-wien\">Strafverfahrens <\/a>vorgehen.
