S\u00e4mtliche Anfechtungsgr\u00fcnde m\u00fcssen bereits in der Klage geltend gemacht werden. Ein \u201eNachschieben\u201c von Gr\u00fcnden nach Einbringung der Klage bei Gericht ist nicht mehr m\u00f6glich.<\/p>\n<p class=\"\" style=\"white-space: pre-wrap;\">Die Anfechtungsfrist bei K\u00fcndigungen richtet sich danach, ob in Ihrem Betrieb ein Betriebsrat errichtet ist oder nicht. Als Faustregel l\u00e4sst sich sagen, dass f\u00fcr die Anfechtung einer K\u00fcndigung immer die zweite Woche die \u201egute Woche\u201c ist.<\/p>\n<p class=\"\" style=\"white-space: pre-wrap;\">Bei einer Entlassung sollten Sie noch rascher handeln, weil die Frist f\u00fcr die Anfechtungsklage in manchen F\u00e4llen nur eine Woche ab Erhalt der Entlassung betr\u00e4gt. In beiden F\u00e4llen beginnt die Frist mit der Kenntnis der K\u00fcndigung bzw. Anspr\u00fcche Ihrer Arbeitnehmer (z.B. Zuschl\u00e4ge, Mehr- und \u00dcberstunden, Gehalts- und Lohndifferenzen) vor den Arbeits- und Sozialgerichten.<\/p>\n<p class=\"\" style=\"white-space: pre-wrap;\">K\u00fcndigungen k\u00f6nnen zwar ohne Grund erfolgen, im Anfechtungsverfahren muss sich der Arbeitgeber dennoch f\u00fcr die K\u00fcndigung rechtfertigen (insbesondere bei der Anfechtung wegen Sozialwidrigkeit) oder darlegen, dass das vom Arbeitnehmer behauptete verp\u00f6nte Motiv (z.B. Diskriminierung oder Geltendmachung von nicht offenbar unberechtigten Anspr\u00fcchen) nicht vorliegt.<\/p>\n<p class=\"\" style=\"white-space: pre-wrap;\">Im Gegensatz zur K\u00fcndigung muss bei der Entlassung immer ein Entlassungsgrund vorliegen, der im Verfahren behauptet und bewiesen werden muss.<\/p>\n<h3 style=\"white-space: pre-wrap;\">Bei den Entlassungsgr\u00fcnden muss zwischen Arbeitern und Angestellten unterschieden werden:<\/h3>\n<ul data-rte-list=\"default\">\n<li>\n<p class=\"\" style=\"white-space: pre-wrap;\">F\u00fcr Angestellte gilt das <a href=\"https:\/\/www.ris.bka.gv.at\/GeltendeFassung.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10008069\" target=\"_blank\" rel=\"noopener\">Angestelltengesetz (AngG)<\/a>, welches die Entlassungsgr\u00fcnde nur beispielhaft aufz\u00e4hlt: z.B. Untreue des Angestellten, Vertrauensunw\u00fcrdigkeit, beharrliche Pflichtverletzung oder unentschuldigtes Fernbleiben.<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space: pre-wrap;\">Die Entlassung eines Angestellten kann daher auch mit einem Fehlverhalten begr\u00fcndet werden, das nicht im Angestelltengesetz steht.<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space: pre-wrap;\">F\u00fcr Arbeiter gilt die <a href=\"https:\/\/www.ris.bka.gv.at\/GeltendeFassung.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10007517\" target=\"_blank\" rel=\"noopener\">Gewerbeordnung (GewO)<\/a>, die die Entlassungsgr\u00fcnde abschlie\u00dfend aufz\u00e4hlt: z.B. Arbeitsunf\u00e4higkeit, bestimmte strafbare Handlungen oder Inhaftierung.<\/p>\n<\/li>\n<li>\n<p class=\"\" style=\"white-space: pre-wrap;\">Bei der Entlassung eines Arbeiters muss ein in der Gewerbeordnung genannter Entlassungsgrund vorliegen.<\/p>\n<\/li>\n<\/ul>\n<h3 style=\"white-space: pre-wrap;\">Entlassung von Lehrlingen<\/h3>\n<p class=\"\" style=\"white-space: pre-wrap;\">Dasselbe gilt f\u00fcr die Entlassung von Lehrlingen, wobei die Entlassungsgr\u00fcnde f\u00fcr Lehrlinge nicht in der Gewerbeordnung, sondern im Berufsausbildungsgesetz abschlie\u00dfend aufgez\u00e4hlt sind: z.B. Diebstahl, Veruntreuung oder sonstige strafbare Handlung oder beharrliche Pflichtverletzung.<\/p>\n<p class=\"\" style=\"white-space: pre-wrap;\">In allen F\u00e4llen muss die Entlassung rechtzeitig erfolgen. Auch dies gilt es im Verfahren zu behaupten und zu beweisen.<\/p>\n<h3 style=\"white-space: pre-wrap;\">K\u00fcndigungs- bzw. Entlassungsschutz<\/h3>\n<p class=\"\" style=\"white-space: pre-wrap;\">Sowohl bei der K\u00fcndigung als auch bei der Entlassung darf der besondere Schutz von bestimmten Arbeitnehmergruppen (beispielsweise Betriebsr\u00e4te, beg\u00fcnstigt behinderte Arbeitnehmer oder Arbeitnehmer in Elternteilzeit) nicht \u00fcbersehen werden.<\/p>\n<h3 style=\"white-space: pre-wrap;\">Risiken bei der Anfechtung einer K\u00fcndigung bzw. Entlassung<\/h3>\n<p class=\"\" style=\"white-space: pre-wrap;\">Das Risiko von Anfechtungsverfahren liegt insbesondere darin, dass die K\u00fcndigung oder Entlassung vom Gericht f\u00fcr rechtsunwirksam erkl\u00e4rt wird und der zu Unrecht gek\u00fcndigte bzw. entlassene Arbeitnehmer im Betrieb weiterbesch\u00e4ftigt werden muss.<\/p>\n<p class=\"\" style=\"white-space: pre-wrap;\">Hinzu kommt, dass dem Arbeitnehmer sein Entgelt (Lohn bzw. Gehalt samt regelm\u00e4\u00dfiger \u00dcberstunden, Zuschl\u00e4ge etc.) seit dem Ende des Dienstverh\u00e4ltnisses (K\u00fcndigungstag oder Entlassungstag) samt Zinsen nachbezahlt werden muss.<\/p>\n<p class=\"\" style=\"white-space: pre-wrap;\">Bei der Anfechtung einer Entlassung gibt es die Besonderheit, dass der Arbeitnehmer die Entlassung gegen sich wirken lassen kann und er so zustellen ist, wie wenn er zum Entlassungstag gek\u00fcndigt worden w\u00e4re.<\/p>\n<p class=\"\" style=\"white-space: pre-wrap;\">In diesem Fall erh\u00e4lt er Ersatzanspr\u00fcche (z.B. die K\u00fcndigungsentsch\u00e4digung).<\/p>\n<p class=\"\" style=\"white-space: pre-wrap;\">Je nach Lage des Falles empfiehlt es sich daher, die K\u00fcndigung oder Entlassung in eine einvernehmliche Aufl\u00f6sung des Dienstverh\u00e4ltnisses \u201eumzuwandeln\u201c bzw. sich mit dem Arbeitnehmer zu vergleichen.<\/p>\n<p class=\"\" style=\"white-space: pre-wrap;\">Auch hier k\u00f6nnen Sie auf meine Beratung als Ihr Spezialist im Arbeitsrecht z\u00e4hlen.<\/p>\n<h3 style=\"white-space: pre-wrap;\">Verwaltungsstrafverfahren mit Bezug zum Arbeitsrecht<\/h3>\n<p class=\"\" style=\"white-space: pre-wrap;\">Arbeitgeber vertrete ich auch in Verwaltungsstrafverfahren mit Bezug zum Arbeitsrecht (z.B.
